Article 1 \u2013 Definitions<\/p>\r\n

In these general terms and conditions the following definitions apply:<\/p>\r\n

    \r\n
  1. Company: Cakepro International B.V., established at Porstmuiden 94, 1046 AM Amsterdam.<\/li>\r\n
  2. Customer: any natural or legal person who enters into an agreement via the website.<\/li>\r\n
  3. Consumer: a natural person who is not acting in the exercise of a profession or business.<\/li>\r\n
  4. Agreement: any distance sales agreement concluded via www.cakepro.nl.<\/li>\r\n
  5. Website: the online platform accessible via www.cakepro.nl.<\/li>\r\n
  6. Product: all goods offered by Cakepro, both food products and non-food products.<\/li>\r\n
  7. Right of withdrawal: the right of the consumer to dissolve the agreement within 14 days without stating reasons.<\/li>\r\n<\/ol>\r\n

    Article 2 \u2013 Applicability<\/p>\r\n

      \r\n
    1. These general terms and conditions apply to all offers and agreements via the Website.<\/li>\r\n
    2. By placing an order, the customer declares agreement with these conditions.<\/li>\r\n
    3. Deviations are only valid if confirmed in writing by Cakepro.<\/li>\r\n<\/ol>\r\n

       <\/p>\r\n

      Article 3 \u2013 Formation of the agreement<\/p>\r\n

        \r\n
      1. The agreement is formed at the moment the order has been placed and the payment has been successfully completed.<\/li>\r\n
      2. Cakepro reserves the right to refuse an order for justified reasons.<\/li>\r\n
      3. Electronic communication is regarded as legally valid evidence.<\/li>\r\n<\/ol>\r\n

         <\/p>\r\n

        Article 4 \u2013 Prices and payment<\/p>\r\n

          \r\n
        1. All prices include VAT, unless stated otherwise.<\/li>\r\n
        2. Obvious price or system errors do not bind Cakepro.<\/li>\r\n
        3. Payment may take place via Stripe (credit card\/debit card), iDEAL and Stripe Link.<\/li>\r\n
        4. Payments are securely processed by Stripe. Cakepro has no access to full card details.<\/li>\r\n
        5. Delivery only takes place after full payment.<\/li>\r\n<\/ol>\r\n

          Article 5 \u2013 Delivery<\/p>\r\n

            \r\n
          1. Delivery takes place after receipt of payment.<\/li>\r\n
          2. Stated delivery times are indicative and not binding.<\/li>\r\n
          3. The customer is responsible for providing correct address details.<\/li>\r\n
          4. Delay by carriers does not give the right to compensation.<\/li>\r\n<\/ol>\r\n

             <\/p>\r\n

            Article 6 \u2013 Retention of title<\/p>\r\n

            Delivered products remain the property of Cakepro until full payment has taken place.<\/p>\r\n

             <\/p>\r\n

            Article 7 \u2013 Warranty and conformity<\/p>\r\n

              \r\n
            1. Cakepro guarantees that the products meet reasonable expectations.<\/li>\r\n
            2. In case of defective delivery, the statutory rights of the consumer remain in force.<\/li>\r\n
            3. Incorrect or improper use falls outside warranty.<\/li>\r\n<\/ol>\r\n

               <\/p>\r\n

              Article 8 \u2013 Right of withdrawal<\/p>\r\n

                \r\n
              1. The consumer has the right to withdraw from the agreement within 14 days after receipt.<\/li>\r\n
              2. Withdrawal must take place by means of an unequivocal statement.<\/li>\r\n
              3. To start a return procedure, the return form must be completed.<\/li>\r\n
              4. Unauthorized returns may be refused or returned at the sender\u2019s expense.<\/li>\r\n<\/ol>\r\n

                 <\/p>\r\n

                Article 9 \u2013 Exceptions for food products<\/p>\r\n

                In connection with hygiene and food safety, the right of withdrawal does not apply to:<\/p>\r\n

                  \r\n
                1. Opened food products;<\/li>\r\n
                2. Products whose seal has been broken;<\/li>\r\n
                3. Products that cannot be resold for hygienic reasons;<\/li>\r\n
                4. Perishable products or products with a short shelf life;<\/li>\r\n
                5. Personalized or custom-made products.<\/li>\r\n<\/ol>\r\n

                  Opened food products are under no circumstances accepted for return.<\/p>\r\n

                   <\/p>\r\n

                  Article 10 \u2013 Return conditions<\/p>\r\n

                    \r\n
                  1. Products must be returned unopened, undamaged and in original packaging.<\/li>\r\n
                  2. The costs of return shipment are always at the expense of the customer.<\/li>\r\n
                  3. In case of depreciation, a reasonable reduction may be applied.<\/li>\r\n<\/ol>\r\n

                     <\/p>\r\n

                    Article 11 \u2013 Promotions and discounts<\/p>\r\n

                      \r\n
                    1. Promotions are valid while stocks last.<\/li>\r\n
                    2. Cakepro reserves the right to modify or terminate promotions without prior notice.<\/li>\r\n
                    3. Obvious pricing errors do not give the right to delivery.<\/li>\r\n
                    4. In case of misuse, an order may be cancelled.<\/li>\r\n<\/ol>\r\n

                       <\/p>\r\n

                      Article 12 \u2013 Liability<\/p>\r\n

                      Cakepro is not liable for:<\/p>\r\n

                      – Incorrect use of products;<\/p>\r\n

                      – Allergic reactions;<\/p>\r\n

                      – Professional application errors;<\/p>\r\n

                      – Indirect or consequential damage;<\/p>\r\n

                      – Damage caused by third parties during transport.<\/p>\r\n

                      The liability of Cakepro is limited to a maximum of the purchase amount of the product concerned.<\/p>\r\n

                       <\/p>\r\n

                      Article 13 \u2013 Force majeure<\/p>\r\n

                      Cakepro is not liable for shortcomings as a result of force majeure, including natural disasters, strikes, malfunctions or supply problems.<\/p>\r\n

                       <\/p>\r\n

                      Article 14 \u2013 Intellectual property<\/p>\r\n

                      All content of the website, including texts and images, is the property of Cakepro and may not be used without permission.<\/p>\r\n

                       <\/p>\r\n

                      Article 15 \u2013 Electronic communication<\/p>\r\n

                      Electronic communication between parties is equated with written communication.<\/p>\r\n

                       <\/p>\r\n

                      Article 16 \u2013 Applicable law and disputes<\/p>\r\n

                      Dutch law applies to this agreement.<\/p>\r\n
