GENERAL TERMS AND CONDITIONS
Cakepro International B.V.
Article 1 – Definitions
In these general terms and conditions the following definitions apply:
- Company: Cakepro International B.V., established at Porstmuiden 94, 1046 AM Amsterdam.
- Customer: any natural or legal person who enters into an agreement via the website.
- Consumer: a natural person who is not acting in the exercise of a profession or business.
- Agreement: any distance sales agreement concluded via www.cakepro.nl.
- Website: the online platform accessible via www.cakepro.nl.
- Product: all goods offered by Cakepro, both food products and non-food products.
- Right of withdrawal: the right of the consumer to dissolve the agreement within 14 days without stating reasons.
Article 2 – Applicability
- These general terms and conditions apply to all offers and agreements via the Website.
- By placing an order, the customer declares agreement with these conditions.
- Deviations are only valid if confirmed in writing by Cakepro.
Article 3 – Formation of the agreement
- The agreement is formed at the moment the order has been placed and the payment has been successfully completed.
- Cakepro reserves the right to refuse an order for justified reasons.
- Electronic communication is regarded as legally valid evidence.
Article 4 – Prices and payment
- All prices include VAT, unless stated otherwise.
- Obvious price or system errors do not bind Cakepro.
- Payment may take place via Stripe (credit card/debit card), iDEAL and Stripe Link.
- Payments are securely processed by Stripe. Cakepro has no access to full card details.
- Delivery only takes place after full payment.
Article 5 – Delivery
- Delivery takes place after receipt of payment.
- Stated delivery times are indicative and not binding.
- The customer is responsible for providing correct address details.
- Delay by carriers does not give the right to compensation.
Article 6 – Retention of title
Delivered products remain the property of Cakepro until full payment has taken place.
Article 7 – Warranty and conformity
- Cakepro guarantees that the products meet reasonable expectations.
- In case of defective delivery, the statutory rights of the consumer remain in force.
- Incorrect or improper use falls outside warranty.
Article 8 – Right of withdrawal
- The consumer has the right to withdraw from the agreement within 14 days after receipt.
- Withdrawal must take place by means of an unequivocal statement.
- To start a return procedure, the return form must be completed.
- Unauthorized returns may be refused or returned at the sender’s expense.
Article 9 – Exceptions for food products
In connection with hygiene and food safety, the right of withdrawal does not apply to:
- Opened food products;
- Products whose seal has been broken;
- Products that cannot be resold for hygienic reasons;
- Perishable products or products with a short shelf life;
- Personalized or custom-made products.
Opened food products are under no circumstances accepted for return.
Article 10 – Return conditions
- Products must be returned unopened, undamaged and in original packaging.
- The costs of return shipment are always at the expense of the customer.
- In case of depreciation, a reasonable reduction may be applied.
Article 11 – Promotions and discounts
- Promotions are valid while stocks last.
- Cakepro reserves the right to modify or terminate promotions without prior notice.
- Obvious pricing errors do not give the right to delivery.
- In case of misuse, an order may be cancelled.
Article 12 – Liability
Cakepro is not liable for:
– Incorrect use of products;
– Allergic reactions;
– Professional application errors;
– Indirect or consequential damage;
– Damage caused by third parties during transport.
The liability of Cakepro is limited to a maximum of the purchase amount of the product concerned.
Article 13 – Force majeure
Cakepro is not liable for shortcomings as a result of force majeure, including natural disasters, strikes, malfunctions or supply problems.
Article 14 – Intellectual property
All content of the website, including texts and images, is the property of Cakepro and may not be used without permission.
Article 15 – Electronic communication
Electronic communication between parties is equated with written communication.
Article 16 – Applicable law and disputes
Dutch law applies to this agreement.
Disputes are submitted to the competent court in the Netherlands.
